Fowl Permit

Brigham City allows citizens to keep and maintain fowls in most residential areas of the city subject to Ordinance 25-02. There is a one-time permit required at the cost of $10.00. Male chickens and crowing hens, guinea fowl, emu, ostrich, peacock, turkey, goose, and swan are not allowed. The number of fowls you may be allowed depends upon your size of lot. The minimum number of fowls is two (2) for the social wellness of the fowls. The permitted number of fowls based on the size of lot is as follows:

  • 6,000 square feet—4 fowls

  • 8,000 square feet—6 fowls

  • 10,000 square feet—8 fowls

  • 14,000 square feet—10 fowls

  • 20,000 square feet—12 fowls

No more than 12 fowls will be permitted on any lot.

A site plan is to be submitted with the application to show the location and dimensions of the proposed coop, pen, and run.

A predator proof coop with a minimum of 2.5 square feet per fowl shall be provided. The coop shall not be larger than 200 square feet and shall be located in the back yard. If the lot is a corner lot the coop shall not be within 20 feet of the side yard setback. There shall also be an enclosed run with a minimum of 5 square feet per fowl. Fowls are not allowed to run or roam free outside of a fenced area. All coops and runs shall be kept clean and free from objectionable odor.

The keeping of residential fowls cannot be used for a business or monetary gain, including the sale of eggs. No slaughtering of fowls can take place on the premises at any time. Dead fowls and unused eggs must be removed and disposed of within 24 hours.

It is unlawful for the owner of any fowl to permit such fowl to trespass or go upon the premises of another or to run at large on any public road, public property or public park. It is also unlawful for the owner to release such fowl upon the premises of another or upon any public property or public park.

A permit may be revoked where a complaint is made to the City about noise, odor or other violation(s) as verified by the City Animal Control Officer, if the owner of the property fails to mitigate the noise, odor or other violation. Any violation of the ordinance shall be considered a Class C Misdemeanor.
